CWA TERMS


ACCEPTANCE OF ORDER - All Contracts are accepted subject to a survey by the company. If as a result of the Surveyors Report, the contract carried out for the price quoted by reason of its nature or if incorrect pricing, the customer will be informed either that the contract can not be carried out and is cancelled or that it can be carried out at an amended price. Within five days receiving notice of an amended price, the customer may cancel the contract by sending written notice to that effect to the Company. If the contract is cancelled pursuant to this condition by the Company or the Customer the deposit paid by the Customer will be refunded in full. The company will try to fulfil the contract as is reasonably possible but time will not be of the essence of the contract.

PAYMENT - Payment of the balance of money specified in the contract shall be immediately due upon installation. Payment maybe made either by cash or cheque. Cheques made payable to the order of the Company and cheques or cash handed to its accredited agent or representative, but in any case, the customer must retain a copy of the contract with payment indicated. The customer shall not be entitled to withhold payment by reason of any alleged defect. The Company will investigate any alleged defect after full payment of the balance.

MATERIALS - All materials shall be of good quality but the Company shall be under no liability whatsoever in respect of minor blemishes and imperfections not caused by us.

INSTALLATION - The customer shall grant the Company's employees access to the premises at reasonable times for the purposes of taking measurements of carrying out the work specified. The company accepts no responsibility for any damage resulting from structural or other defects in the property at which the installations carried out. The customer shall be responsible for the removal of all internal fittings that are considered necessary in the opinion of the Company's installers to enable the installation to be carried out.

GUARANTEE - Our products are covered for one year from installation date, the electric motors for 5 years. Under this guarantee liability will not be accepted if any attempt is made to carry out any repair or adjustment by any person other than the Company's accredited service agents.

LIMITED LIABILITY - The company will not be liable in contract tort or otherwise for any special indirect or consequential damage of any nature whatsoever. The company's liability for loss or damage in contract tort otherwise in relation to this contract shall be limited to the price charged for the provision of the goods service. Where the customer is a customer (as defined by the unfair contract terms act 1977) noting in these conditions shall affect their statutory rights.

RETENTION OF TITLE - The company will remain the sole and absolute owner of all equipment supplied under this contract until payment in full has been made. Until receipt by the company of such payment the customer will hold the equipment for the company as bailee and will not move any such equipment from the place in which it has been installed. When payment of the contract price is overdue the customer suffers distress or execution to be levied against their effects, makes arrangements or composition with their creditors or has a receiving order in bankruptcy made against them then the company shall be entitled to recover equipment from the customer. The company may for the purpose of recovery of its equipment enter the premises where it is installed and may remove the same.
